1) Acceptance of Terms

These Terms and Conditions govern your use of the Vanish application and related websites (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Service.

Additional documents that form part of your agreement with us include the Privacy Policy and the Rules & How It Works, which describe how the system functions in practice.

2) Eligibility

• The Service is not directed to children. In the EEA/UK, you must be at least 16 years old (or the lower age of digital consent set by your country) to use the Service.
• By using the Service, you represent that you meet the minimum age requirement and that you have the legal capacity to enter into a binding agreement.
• If you are using the Service on behalf of another person or entity, you represent that you are authorised to accept these Terms on their behalf.

3) Accounts & Access

3.1 Temporary and Normal Accounts

• Temporary accounts are disposable profiles that typically expire after one hour unless you extend them. They allow participation in chats and groups but may be restricted from creating groups.
• Normal accounts require a username, password, and a chosen country and city. Passwords are stored in hashed form.
• We do not require your legal name, email address, or phone number for normal operation. Additional technical signals may be processed only in the specific circumstances described in the Privacy Policy and in these Terms.

3.2 Account Security

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must inform us promptly if you believe that your account has been compromised.

3.3 Non-Transferability

• Your account is personal to you and may not be sold, transferred, or assigned to any other person without our prior written consent.

4) Veils, Items & Marketplace

Veils are the in-app currency. Items are virtual objects that can affect visibility, group governance, or other game mechanics.

4.1 Nature of Veils and Items

• Veils and items are virtual features that exist solely within the Service. They do not represent real-world money, financial instruments, or property rights.
• You do not own Veils or items in the legal sense. Instead, you receive a limited, revocable licence to use them within the Service, subject to these Terms.

4.2 Acquisition and Use

• You may obtain Veils by completing rewarded advertisements, trading with other users, or participating in group and marketplace activity.
• Veils can be spent on items, boosts, shaming actions, and other in-app mechanics.
• All transfers and significant uses of Veils and items may be logged in public or group-specific ledgers.

4.3 No Real-Money Trading

• You must not buy, sell, or exchange Veils or items for real-world money, goods, or services.
• You must not use the Service to operate any form of real-money gambling, investment scheme, or financial service.
• We may suspend or terminate accounts involved in real-money trading or off-platform deals involving Veils or items.

4.4 No Refunds

• Veils and items are non-refundable and have no cash value. Where you receive them via rewarded advertisements or gameplay, there is no right of refund or compensation if you lose access to them through suspension, deletion, or changes to the Service.

5) User Behaviour & Prohibited Uses

You are responsible for your behaviour and content. You agree not to:

• Engage in harassment, hate speech, credible threats, or targeted abuse.
• Share, request, or promote sexual content involving minors or any form of child sexual abuse material.
• Doxx or share personal data of others without their consent.
• Use the Service for spam, scams, phishing, or fraudulent schemes.
• Upload, share, or promote content that is clearly illegal in your jurisdiction (for example, certain copyrighted material, extreme violence, or terrorism content).
• Use bots, scripts, or automated tools to manipulate elections, marketplace prices, or Veil balances, except where explicitly authorised.
• Attempt to bypass suspensions, bans, or technical controls, including through multiple accounts or device resets.

Failure to comply with these rules may result in suspensions, permanent bans, or other enforcement actions as described below.

6) User Content & Licences

6.1 Your Content

• You retain any rights that you hold in the content you submit to the Service, such as messages, group names, ledger entries, and marketplace listings.
• You are responsible for ensuring that your content does not infringe the rights of others and does not violate applicable law or these Terms.

6.2 Licence to Vanish

• By submitting content to the Service, you grant us a non-exclusive, worldwide, royalty-free licence to use, host, store, reproduce, modify, and display that content as needed to operate the Service, including for backups, moderation, and technical optimisation.
• This licence continues for as long as your content is stored on our systems, subject to retention limits and automatic expiry mechanisms (for example, disappearing messages).

6.3 Disappearing and Logging

• Certain content such as messages is designed to expire after a limited time or based on group settings.
• Other data, such as ledger entries for transfers, votes, and key actions, may persist longer to maintain transparency and game integrity.

7) Moderation, Enforcement & Bans

Moderation is primarily automated and based on rules, user reports, behavioural patterns, honeypot traps, and spam detection.

7.1 Automated Decisions

• Reports and certain behaviours may be analysed using automated systems, including third-party moderation models.
• Moderation decisions, including suspensions and bans, are based on these automated evaluations and rule thresholds.

7.2 Enforcement Ladder

• For non-severe behaviour (for example, spam, harassment, repeated low-level violations), the system may apply escalating suspensions, starting with short lockouts and increasing in duration with repeated offences.
• For severe violations (for example, child sexual abuse material, explicit sexual content involving minors, extreme violence, or clear large-scale copyright infringement), the Service may immediately remove content and permanently ban the account.
• In severe cases only, the Service may temporarily process device identifiers and coarse location/IP information to enforce hard bans and reduce evasion, as described in the Privacy Policy.

7.3 Appeals

• Due to the scale and automated nature of the Service, there is no formal appeal system in-app and no guarantee of human review.
• You may contact support if you believe a technical error occurred, but many decisions will remain fully automated and final.

8) Advertising & Third Parties

• The Service uses advertising, including rewarded ads, primarily delivered by Google AdMob.
• Third-party providers may process device identifiers, approximate location, and other technical data to deliver and measure ads and to detect fraud.
• In certain regions, you will be asked for consent to personalised ads and may choose non-personalised ads instead. Your choices are honoured in line with applicable law.
• Your use of third-party services is subject to their own terms and privacy policies. Where those parties act as independent controllers, you may need to exercise your rights directly with them.

9) Intellectual Property

• All rights in the Service, including logos, branding, code, designs, and text (excluding user content), are owned by or licensed to Vanish and are protected by intellectual property laws.
• Subject to your compliance with these Terms, you receive a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes.
• You must not copy, modify, distribute, reverse engineer, or create derivative works from the Service, except where permitted by law.

10) Disclaimers

• The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
• We do not guarantee uninterrupted or error-free operation, nor do we guarantee that content will be preserved or accessible at all times.
• We do not provide financial, legal, or investment advice. The in-app economy is an entertainment mechanic and is not a real-world market.
• We do not guarantee that automated moderation will correctly identify or remove all harmful, illegal, or infringing content.

11) Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
• Our total aggregate liability to you for any claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you have paid to us in the last twelve months (if any) and (b) EUR 10.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (for example, for fraud or certain statutory rights).

12) Termination

• You may stop using the Service at any time.
• We may suspend or terminate your access to the Service, or remove content, if we reasonably believe that you have breached these Terms, violated the law, or created risk or possible legal exposure for us or other users.
• In certain cases (for example, suspected child sexual abuse material), we may be legally required to preserve limited information for law-enforcement purposes, notwithstanding any account deletion.

13) Changes to the Service & Terms

• We may modify or discontinue parts of the Service at any time, including features related to Veils, items, groups, or moderation.
• We may update these Terms from time to time to reflect changes to the Service, legal requirements, or business needs.
• When we make material changes, we will update the effective date and, where reasonable, provide additional notice in-app or on the website.
• Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14) Governing Law & Disputes

• These Terms are governed by the laws of Ireland, without regard to conflict-of-law principles.
• Courts in Ireland will have non-exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. This means you may also have certain rights to bring claims in your local courts under mandatory consumer-protection law.
